Petitioner is in custody in connection with Riga P.S. Case No. 75 of 2019 for the offence Sections 272, 273 of the Indian Penal Code and section 30(A) of the Bihar Prohibition & Excise Act, 2016.

In the instant case total 125.23 liters of foreign wine was seized from a wheat field and not from the possession of the petitioner.

Learned counsel for the petitioner submits that petitioner has no criminal antecedent and nothing was recovered from the possession of the petitioner.

The petitioner is in custody since 7.3.2019.

Considering the fact that liquor was seized from the

No.30927 of 2019(2) dt.29-05-2019 2/2 wheat field and considering the fact that petitioner has no criminal antecedent, the Court is inclined to grant bail to the petitioner, let the petitioner, named above, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of IInd Additional District and Sessions Judge-cum-Special Judge, Excise Act, Sitamarhi, in connection with Riga P.S. case No. 75 of 2019.
