The petitioner apprehends his arrest in connection with Agamkuan P.S. Case No. 336 of 2020 registered for the offences punishable under Sections 304(B)/34 of the Indian Penal Code and Sections 3⁄4 of Dowry Prohibition Act. As per allegation in the F.I.R, three accused persons including the petitioner (Dewar) of the deceased are alleged to have killed the daughter of the informant for dowry. Learned counsel for the petitioner submits that similarly situated co-accused has been granted bail by this Coordinate Bench of this Court vide order dated 08.02.2021 passed in Cr. Misc. No.31598 of 2020 and petitioner is the Dewar of the deceased. There is no specific allegation or any overt act
Patna High Court CR. MISC. No.31410 of 2020(3) dt.24-02-2021 2/2 against the petitioner. He further submits that the husband of the deceased has been granted regular bail by the court below itself on 15.12.2020.
Learned A.P.P. for the State opposed the bail petition. In the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 25,000/- (twenty five thousand) with two sureties of the like amount each to the satisfaction of ACJM 1st, Patna City, Patna in connection with Agamkuan P.S. Case No. 336 of 2020, subject to the condition as laid down under Section 438(2) of the Cr.P.C. (Anjani Kumar Sharan, J) Nasimul/- U T
