Petitioner seeks bail in Excise Case No.943 of 2018 arising out of Karpi P.S. Case No.137 of 2018 instituted for the offence under Section(s) 420, 120-B Indian Penal Code and Section 30(a) of Bihar Prohibition and Excise Act, 2016. It is alleged in the written report that police got information that Krishna Yadav has brought foreign liquor by truck of Haryana number and kept the same in Dariyapur ITI Campus. The informant along with police personnel raided the place but the accused persons fled away due to darkness. It is alleged that the police recovered altogether total 2664 bottles foreign liquor from truck. 132 bottles of foreign liquor each of 750 ML was recovered from Bolero vehicle and 72 bottles of

The police in the torch light identified this petitioner and Krishna Yadav fled away from the place of occurrence. From the written report, it is apparent that petitioner was not apprehended on the spot. Police has raised mere suspicion against the petitioner. There is no recovery of illicit liquor from possession of the petitioner.

Counsel for the petitioner submits that Petitioner is in custody since 10.01.2019 having clean antecedents. In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Special Judge, Excise cum Additional Sessions Judge 2, Jehanabad, in connection with Excise Case No.943 of 2018 arising out of Karpi P.S. Case No.137 of 2018, subject to the condition that both the bailors shall be close relative of the petitioner.
