2. The petitioner has prayed for bail in connection with Tariyani P.S. Case No. 80 of 2023 registered for the offence punishable under Sections 306, 34 of the Indian Penal Code.
3. The case of the prosecution 'in short' is that the daughter of the informant aged about 15 years was a student of Class-8. It is alleged that in her route to school she was being teased by the petitioner and one Arvind Sah. Few days ago, the daughter of the informant was stopped in route to her school and her Dupatta was pulled away by the petitioner. When the wife of the informant inquired from the victim, she narrated the occurrence to her whereon the wife of the informant conveyed the matter to informant. The family members went to the house of the petitioner where they were abused.
4. Learned counsel appearing on behalf of the petitioner has submitted that petitioner is innocent and has committed no offence. He has been falsely implicated in this case. The victim has left her education in the year 2019 itself but the alleged occurrence is alleged to have taken place in year 2023. It has further been submitted that from F.I.R. it is clear that the allegation is that the petitioner was teasing the victim in her route to school. When she has left the school in the year 2019 teasing her in route to school in the year 2023 seems false and improbable. It has also been submitted that the victim was married and was living in her matrimonial home. Though, there is allegation that this petitioner demanded her mobile number from the victim girl and on her refusal he used to tease her in her route to school. Everywhere it has appeared in the diary that the petitioner was teasing and stalking the victim in her route to school but the victim has left her education in the year 2019.
Patna High Court CR. MISC. No.31328 of 2025(2) dt.21-05-2025 3/3 Though, she has committed suicide but the reason is very remote. A statement has been made in para 3 of the petition that petitioner has no criminal antecedent. He is languishing in judicial custody since 08.04.2025.
5. The application for bail is vehemently opposed by learned APP for the State.
6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Sheohar in connection with Tariyani P.S.
