The petitioner seeks bail in Pupri P.S. Case No. 82/2019, instituted for offences under Section(s) 363 and 366(A) of the Indian Penal Code.

It is alleged in the written report that daughter of informant suddenly became disappear from her house in the evening. The informant during search learnt from shopkeeper, namely, Sarfaraz @ Badre that his daughter was seen in the Cinema Hall with two boys. One of them is Shahid Afridi. The victim has been recovered and gave her statement under Section 164 Cr.P.C., wherein she has stated that she had gone on bike with Jamshed Ansari (Petitioner), who took her on lonely place and committed illegal act with her. Learned counsel for the petitioner has submitted that victim has filed a petition before the court below dated 19.03.2019 stating therein that the occurrence has been done with her by Shahid Afridi and not by this petitioner. In the F.I.R. also informant has taken name of Shahid Afridi. Petitioner is in custody since 21.02.2019.

Considering the aforesaid facts and circumstances, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Pupri, Sitamarhi, in connection with Pupri P.S. Case No. 82/2019, subject to the conditions that both the bailors shall be the close relative of the petitioner.
