JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 07-12-2018 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner apprehends his arrest in connection with Complaint Case No. 1120 of 2016 registered for the offences punishable under Sections 420, 467, 468, 471 and 120B of the Indian Penal Code.

The complainant claims that the petitioner and other accused got executed sale deed dated 15.6.2007 in respect of lands of complainant by playing fraud upon her and when she came to know about the aforesaid fact, she filed the present complaint case in the year 2016 that is after nine years. The petitioner happens to be the full-brother of the complainant and has been shown as witness on the aforesaid sale deed.

No.67595 of 2018(2) dt.07-12-2018 2/2 Therefore, considering the aforesaid facts and circumstances as well as submissions of the parties, this anticipatory bail petition is allowed and it is ordered that petitioner, in the event of his arrest/ surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Nawada in Complaint Case No. 1120 of 2016 subject to conditions as laid down under Section 438(2) of the Cr.P.C.
