JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 13-09-2018 In view of the statements made in the show cause filed on behalf of the opposite parties showing that after the order passed by the learned writ Court a sum of Rs.2,40,002/- has been paid but the remaining amount of Rs.4,04,920/- could not be paid because of the paucity of fund and further that the Hon'ble Division Bench of this Court is looking into the matter relating to non-payment of the dues of the employees of the BISCOMAUN and as soon as the
Patna High Court MJC No.2211 of 2016 (6) dt.13-09-2018 2/2 amount will be received from the State Government or any other source the entire outstanding dues of the petitioner shall be paid in one go, this Court does not find any case for initiation of contempt against the Opposite Parties at this stage. In case the petitioner finds that despite availability of the funds BISCOMAUN is not paying the dues of the petitioner who is claiming through his father who is no more, he will be at liberty to file a fresh contempt application showing such discrimination.
Learned counsel for the BISCOMAUN also submits that for payment of a sum of Rs.50,000/- on account of Group Insurance against the salary dues, the petitioner is required to submit a succession certificate and as soon as the same will be furnished the said amount will be made available to the petitioner immediately.
This application stands dismissed with the aforesaid direction.
