Petitioner apprehends his arrest in Charpokhari P.S. Case No.203 of 2018, registered under Sections 341, 323, 354(B), 379 and 34 of the Indian Penal Code as well as under Sections 10 and 12 of the POCSO Act.

The informant alleged that while her daughter Puja Kumari was going to cattle shed with fodder, Arun Singh stalked her. Her daughter raised alarm and many persons assembled there. Arun Singh fled away. Thereafter when the informant went to complain, Bindeshwari Yadav and others, family members of Arun Singh and Arun Singh assaulted the informant and others. Learned counsel for the petitioner submits that petitioner is own co-sharer and close agnates of the husband of the informant. On account of some petty family dispute, some

Patna High Court CR. MISC. No.32280 of 2019(2) dt.15-05-2019 2/2 altercation took place but the informant lodged the case after making false and exaggerated version. Other accused persons have already been enlarged on anticipatory bail vide order dated 19.02.2019, passed in Cr. Misc. No.9468 of 2019. The allegation of stalking the daughter of the informant is palpably false as the daughter of the informant is close relation of the petitioner and the petitioner cannot even think of stalking her.

Considering the facts and nature of allegations made against the petitioner and the fact that the petitioner happens to be close agnates of the husband of the informant, let petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt of this order, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.D.J., 1st, Ara in connection with Charpokhari P.S. Case No.203 of 2018 (POCSO Case No.67 of 2018), subject to the conditions laid down under Section 438(2) Cr.P.C.
