Mr. Nityanand ====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 09-09-2019 Heard learned counsel for the petitioner and the State. The petitioner apprehends his arrest in Araria P.S. Case No. 671 of 2018, registered for the offences punishable under Sections 420, 406, 504, 506 and 34 of the Indian Penal Code.

It is alleged that petitioner has withdrawn Rs. 38,000/- dishonestly from the account of informant's brother using his A.T.M card and also changed the A.T.M card.

Learned counsel for the petitioner has submitted that petitioner has been falsely implicated in this case due to inimical term. The allegation against this petitioner is false and fabricated.

Learned Additional Public Prosecutor however opposed the prayer for bail of the petitioner submitting that

Patna High Court CR. MISC. No.38666 of 2019(3) dt.09-09-2019 2/2 petitioner is named in the F.I.R. There is direct allegation against him of withdrawing amount from the A.T.M card and also changing of A.T.M card.

Considering the nature of offence and also the fact that there is direct allegation against this petitioner, I am not inclined to enlarge the petitioner above-named on anticipatory bail. Accordingly, the same is rejected.
