This is the second attempt on behalf of the petitioner for grant of regular bail arises out of Imamganj P.S. Case No.289 of 2023 registered for the offence punishable under Section 394 of the Indian Penal Code.

Earlier the prayer of the petitioner for grant of bail was rejected by this Court vide order dated 14.03.2024 passed in Criminal Miscellaneous No.17707 of 2024. 4.

Allegation against the petitioner and other accused persons is that they have looted Rs.3,50,000/- and a vehicle from the informant and others.

It has been submitted by learned counsel for

Patna High Court CR. MISC. No.35352 of 2024(6) dt.10-01-2025 2/3 the petitioner that similarly situated accused persons have been granted bail by the Court below. It has further been submitted that the petitioner has clean antecedent and he is ready to cooperate in the trial. The petitioner is in custody since 15.11.2023.

Considering the period of custody of the petitioner as well as the fact that he has clean antecedent, this application is allowed.

Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Sherghati at Gaya, in connection with Imamganj P.S. Case No.289 of 2023, subject to the condition that he will cooperate in the trial and will present himself or through his lawyer on each and every date fixed in the trial, failing which, the bail bonds of the petitioner shall automatically be cancelled.

At the time of accepting the bail bonds of the petitioner, the Court below shall verify the fact whether the petitioner has clean antecedent or not. If it is found that the petitioner is having clean antecedent, his bail bonds shall be accepted. If it is found that the petitioner is accused in some
