JUSTICE ASHUTOSH KUMAR ORAL ORDER 18-12-2018 The petitioners seek bail in anticipation of their arrest in connection with Dhoraiya P.S. Case No. 15 of 2018 dated 28.01.2018 instituted for the offences under Sections 341, 323, 325, 379, 504, 506, 34 of the Indian Penal Code. The petitioner No. 1 is alleged to have assaulted the wife of the informant whereas petitioner No. 2 is alleged to have taken away belongings of the informant as well as his wife.
The learned counsel for the petitioners has informed this Court that the parties are agnates and the dispute arose because of lifting of water by the pump. There is counter version of the occurrence also vide Dhoraiya P.S.
Patna High Court Cr.Misc. No.68992 of 2018(2) dt.18-12-2018 2/2 Case No. 16 of 2018. The injuries suffered by the informant's wife are simple in nature.
Regard being had to the aforesaid facts and the clean antecedents of the petitioners, the petitioners, above named, in the event of their arrest or surrender before the learned Court below within a period of four weeks from today, are directed to be released on bail on their furnishing bail bonds of Rs. 10,000/-(ten thousands) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Banka in connection with Dhoraiya P.S. Case No. 15 of 2018, subject to the conditions laid down under Section 438(2) of the Cr.P.C. (Ashutosh Kumar, J) Shageer/- U T
