ANJANA MISHRA ORAL ORDER 19-12-2018 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is apprehending his arrest in connection with Digha P.S. Case No.354 of 2018 for allegedly having committed the offence under Sections 341, 323 and 354 of the Indian Penal Code.

Learned counsel for the petitioner submits that the entire allegation is on account of previous enmity with the petitioner and he has been falsely implicated in this case. It is further submitted that there is no eye-witness to the occurrence and the allegations are vague and concocted. Considering the aforementioned facts and circumstances and that the petitioner has no criminal antecedents, let the petitioner, above named, in the event of

Case No.354 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
