Petitioner seeks regular bail in a case registered for the offence punishable under Section 302 and some other ancillary Sections of the Indian Penal Code and u/s 27 of Arms Act.

As per the prosecution case, 13 named accused, including this petitioner, persons gathered variously armed and it is alleged that on the instigation of Sushila Devi, Jagdish Karogiya and Manish Yadav fired as a result of which the nephew of informant died on the spot while her husband was injured seriously.

Learned counsel appearing for the petitioner submits

Patna High Court CR. MISC. No.42179 of 2021(2) dt.03-01-2022 2/2 that petitioner is innocent and has falsely been implicated in the case. It is submitted that specific allegation of firing is against Jagdish Korogiya and Manish Yadav and not against this petitioner. Petitioner claims clean antecedent and is in custody since 27.11.2020 and investigation in this case is complete. Learned counsel appearing for the State and the informant opposed the prayer for bail.

Considering the facts of the case and the period of custody of the petitioner, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-I, Birpur, Supaul in connection with Birpur PS case No.85/2020.
