This application is for modification of order dated 18.06.2020 whereby the petitioner was allowed bail on the submission of learned counsel for the petitioner that charges have already been framed in the case.

Learned counsel for the petitioner submits that on the date of making of the submission charges were in fact not framed.

The report of the learned Trial Judge dated 25.11.2020 would reveal that charges have already been framed in this case and the case is running for prosecution evidence. Hence, let the petitioner, above named, be released on bail at once on furnishing bail bond of Rs.20,000/- (Twenty

Patna High Court CR. MISC. No.27181 of 2020(3) dt.16-12-2020 2/2 Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Sahebganj Police Station Case No.432 of 2019 with following conditions:

(a) Both the bailors shall be resident of territorial jurisdiction of the learned Court-below.

(b) The petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.

With the aforesaid modification, this application stands allowed.
