JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 18-12-2018 Heard learned counsel for the petitioner and the State. The petitioner apprehends his arrest in connection with Giriyak (Katrisarai) P.S. Case No. 357 of 2018 for the offence under Sections 30, 38 and 41 of the Bihar Prohibition and Excise Act, 2016.
Learned counsel for the petitioner submits that the petitioner has got no criminal antecedent. He submits that the petitioner has been falsely implicated in this case. He submits that the petitioner was not present at the place of occurrence and he has no concern with the alleged garden from where the liquor was seized.
Considering the fact that the petitioner has got no criminal antecedent, the petitioner named above, in the event of arrest or surrender before the court below within one month
Patna High Court Cr.Misc. No.75118 of 2018(2) dt.18-12-2018 2/2 from today, is directed to be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional District Judge-VI- cum- Special Judge, Excise, Nalanda at Bihar Sharif in connection with Giriyak (Katrisarai) P.S. Case No. 357 of 2018 subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
