ABHISHEK REDDY ORAL ORDER 07-07-2026 This Court vide order dated 11.05.2026 at Para-1 has observed as under:- "Learned counsel appearing on behalf of the Respondent-State seeks time for getting necessary instructions as to whether the request letter of the petitioner dated 20.04.2026 (Annexure-P/17) has been received on the official e-mail or the Executive Engineer, Rural Works Department (EWD), Muzaffarpur Works

2. In the counter-affidavit filed by the Respondent No. 3, specific stand has been taken at Para-5 stating as under:- "5. That it is very humble submitted before the Hon'ble High Court that the request letter the petitioner dated 20.04.2026 has not been received on the official e-mail of the Executive Engineer, Rural Works Department, Works Division, Muzaffarpur East-01."

Learned counsel appearing on behalf of the petitioner submits that the petitioner may be granted liberty to file a fresh representation seeking reconciliation and settlement of the claims made by the petitioner pending the adjudication of the claim by the Public Works Contracts Disputes Arbitration Tribunal.
4. Having regard to the above made submissions, the present writ petition is disposed of granting liberty to the petitioner to file a fresh representation before the Respondent No. 2 i.e. the Principal Secretary, Rural Works Department, Govt. of Bihar, Patna within a period of two weeks from today. On such representation being given, the authority shall consider the same on its own merits in accordance with law. The authority shall endeavour to take a necessary decision as expeditiously as possible preferably within a period of 4 weeks from the date of the receipt of the copy of the said
Patna High Court CWJC No.7403 of 2026(5) dt.07-07-2026 3/3 representation. It is needless to mention that before taking any decision the petitioner shall be put on notice and given an opportunity of hearing. Any decision taken shall be communicated to the party. In case any adverse order is passed, the petitioner is free to avail the remedies as available under the law.
5. With the above directions, the present Writ Petition stands disposed of.
