The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 409, 420 of the Indian Penal Code.

As per the FIR, it is alleged that petitioner by misusing his post and without following the procedure for selection of agency, he selected only one agency namely, Prahlad Natak Group and directed to organize the Drama at 222 places in stead of 40 places and claimed for Rs. 8,80,000/-. It is submitted that petitioner is innocent and has committed no offence. It is submitted that after obtaining the approval for organizing Nukkad Natak for awareness of voters. No.33101 of 2022(2) dt.18-10-2022 2/2 District SVEEP Core Committee headed by the Deputy Development Commissioner, Madhepura being President of the Committee and everything was done under the order of the District Magistrate, Madhepura as contained in Memo No. 194 dated 25.02.2014. Petitioner has only obeyed the order of senior officers. The aforesaid occurrence took place in the year 2014 and the petitioner has already superannuated on 31.01.2021 from the post of District Public Relation Officer while he was posted at Buxar and the FIR has been lodged in the year 2022. Petitioner claims clean antecedent.

Considering the facts aforesaid, the petitioner abovenamed, in the event of his arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Madhepura in connection with Madhepura P.S. Case No. 265 of 2022, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
