Petitioner seeks bail in a case registered for the offences punishable under Sections 25(1-b)a, 26 and 35 of the Arms Act.

The firearm and cartridges were allegedly recovered from house and from physical possession of co-accused Wazid Hussain.

Submission is that no recovery is there from possession of the petitioner. Petitioner is aged about 72 years. Similarly situated other co-accused have been allowed bail by a Co-Ordinate Bench of this Court in Cr. Misc. No. 30253 of 2019.

Considering the aforesaid submission, let the

No.32271 of 2019(2) dt.15-05-2019 2/2 petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Malahi (Govindganj) Police Station Case No. 362 of 2018, with the following conditions:

(a) Both the bailors shall be the resident of territorial jurisdiction of the learned court-below having immovable property.

(b) The petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner. (Birendra Kumar, J) Rajan/- U T
