Learned counsel for appellant-State is relying on a decision rendered in L.P.A. No. 1882 of 2016 decided on 14.12.2017. It is submitted that the present case is similar to that of L.P.A. No. 1882 of 2016.

Accordingly, the present L.P.A. stands allowed in the light of order passed in L.P.A. No. 1882 of 2016 decided on 14.12.2017. Order of the learned Single Judge dated 21.04.2016 passed in C.W.J.C.
