====================================================== CORAM: HONOURABLE MR. JUSTICE ASHUTOSH KUMAR ORAL ORDER 18-08-2021 Heard Mr. Rajani Ranjan Prasad Singh, the learned Advocate for the petitioner and Mr. Anil Kumar, the learned APP for the State.

The petitioner has prayed for grant of bail in connection with Sessions Trial No.29 of 2016 arising out of Charpokhari P. S. Case No.257 of 2015, instituted for the offences under Sections 364, 120(B), 34 and 302 of the Indian Penal Code.

The petitioner was granted bail way back on 11.02.2016. However, the same was cancelled because of his non-appearance. The petitioner was again granted bail on 06.07.2018 with a condition that he shall participate in the trial proceedings on daily basis and his absence would render his bail liable to be cancelled.

Patna High Court CR. MISC. No.41816 of 2021(2) dt.18-08-2021 2/2 On one date, the petitioner could not appear before the trial Court because of his having taken ill. On that day i.e. 04.02.2020, the bail bonds of the petitioner was cancelled. The petitioner was arrested on 26.12.2020 and since then, he is in custody.

Regard being had to the period of custody of the petitioner after the cancellation of the bail bonds, he is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned 14th Additional Sessions Judge, Bhojpur at Ara in connection with Sessions Trial No.29 of 2016 arising out of Charpokhari P. S. Case No.257 of 2015.

However, it is made clear that if again the petitioner would default in appearing before the trial Court without any plausible reason or permission of the trial Court, his bail would again be liable to be cancelled.

The application stands allowed.
