2. The petitioner is apprehending his arrest in connection with Amour P.S. Case No. 73 of 2024 registered for the offences punishable under Section 392 of the Indian Penal Code.

3. As per prosecution case, informant's bag containing IASUS Laptop, Rs. 1,00,000/-, finger device, laptop charger, C.S.P I.D card, Aadhar card, Pan card and other documents were snatched by two miscreants and they fled away from the place of occurrence.

4. Learned counsel for the petitioner submits that petitioner is not named in the FIR and his name has been transpired in the present case on the basis of suspicion. It is

No.35877 of 2025(2) dt.18-06-2025 2/3 further submitted that petitioner is innocent and has committed no offence as alleged in the FIR and he has falsely been implicated in this case. He further submits that petitioner has been working in NTPC Vindyachal as a painter and his attendance card shows that he was on duty at the time of occurrence since 1st February to 16th February 2024. A photocopy of attendance card is annexed as annexure-p/2 of the bail petition. He further submits that petitioner is not found at the place of occurrence. Petitioner is not in any way connected with the alleged occurrence. Apart from that, petitioner bears no criminal antecedent. Nothing has been recovered from the conscious possession of the petitioner. Learned counsel orally submits that petitioner will not abscond rather will cooperate in the investigation to prove his innocence.

5. The learned A.P.P. for the State vehemently opposes the prayer for anticipatory bail of the petitioner.

Considering the facts and circumstances of the case, keeping in view clean antecedent of petitioner, argument advanced on behalf of both sides and also taking into consideration the material available on record, the petitioner above-named, in the event of his arrest or surrender before the learned trial court within a period of six weeks from today, be

No.35877 of 2025(2) dt.18-06-2025 3/3 released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M, Purnia in connection with Amour P.S. Case No. 73 of 2024, subject to the conditions as laid down under Section 438(2) of the Cr.P.C .

However, it is made clear that in the event if the Investigating Officer of the case files an application before the learned trial court bringing to its notice that the petitioner despite giving assurance to this Court is not co-operating in the investigation in that event the learned trial court shall be at liberty to cancel the bail bond of the petitioner.
