The petitioner seeks bail in Asthawan P.S. Case No.225 of 2019, corresponding to G.R. No.5763 of 2019 registered under Section 30(a) of Bihar Prohibition and Excise Act.

The informant intercepted a pick up van but the driver and others managed to flee away taking advantage of darkness. 378 litres of liquor was recovered from the pick up van. The learned counsel for the petitioner submits that petitioner is in jail for about last six months. Petitioner is not the owner of the vehicle. The petitioner has also stated this fact before the learned Sessions Judge that he is not the owner of the pick up van bearing no. BR 21GA-3933 and he has falsely been implicated in the case on mere suspicion. The name of the

Patna High Court CR. MISC. No.31454 of 2020(2) dt.01-12-2020 2/2 owner of the vehicle is Bittu Kumar. The number plate of vehicle was also changed.

Taking into consideration the facts aforesaid, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned 3rd Addl. Sessions Judge-cum-Special Judge(Excise), Nalanda in connection with Asthawan P.S. Case No.225 of 2019, corresponding to G.R. No.5763 of 2019.
