2. The petitioner is apprehending his arrest in Dhamdaha P.S. Case No. 64 of 2025 registered under Sections-406 & 420 of the Indian Penal Code as well as Section-8/20(b)(ii)(C) of the N.D.P.S. Act.

3. According to allegation, amongst two persons travelling by a motorcycle, the co-accused Fakir Mandal was arrested and he disclosed the name of this petitioner, who fled away from the scene of occurrence. 41 kgs. Ganja is said to have been recovered in this case.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and he has falsely been implicated in

Patna High Court CR. MISC. No.35664 of 2025(4) dt.19-11-2025 2/2 this case. The petitioner is not named in the F.I.R. and his name surfaced in the present case on the basis of disclosure, made by apprehended co-accused namely, Fakir Mandal.

5. On the otherhand, the learned counsel for the State has opposed the prayer for anticipatory bail by submitting that the apprehended co-accused Fakir Mandal has categorically stated that the petitioner fled away from the scene of occurrence. The investigating is still going on.

6. Considering the aforesaid facts and circumstances, the petitioner is not entitled for privilege of anticipatory bail and accordingly, the same is rejected.
