JUSTICE VINOD KUMAR SINHA ORAL ORDER 28-11-2018 Earlier prayer for anticipatory bail of the petitioners was rejected by this Court vide order dated 30.8.2018 passed in Cr.Misc.No. 49824 of 2018 with a direction to the petitioners to surrender within a period of six weeks from the date of that order and make prayer for regular bail.
Submission of learned counsel for the petitioners is that surrender certificate of accused, who was fleeing away, could not be produced and as such the present application has been filed for grant of anticipatory bail.
Heard learned APP also.
Having heard both sides and in the facts and circumstances, I am not inclined to interfere with the earlier
Patna High Court Cr.Misc. No.68049 of 2018(2) dt.28-11-2018 2/2 order.
However, if the petitioners surrender within a further period of four weeks from the receipt of this order and pray for regular bail, the same shall be considered by the court below on merit and to be disposed of on the same day, if possible. With the above observation, this application is dismissed.
