In this case, the petitioner is seeking regular bail in connection with Bajpatti P.S. Case No. 100 of 2020 registered for offence punishable under sections 363/366(A)/34 of the Indian Penal Code and section 3 of the POCSO Act. Allegation has been made that the petitioner and others kidnapped the daughter of the informant and when the informant went to the house of the accused persons whereupon one of the accused persons namely Mahendra Manjhi started abusing and said that he will not return the victim girl but the learned counsel for the petitioner has brought to notice of this Court to the statement made by the victim girl under section 164 Cr. PC. in which she has stated that she had voluntarily gone to
Patna High Court CR. MISC. No.31121 of 2020(2) dt.29-01-2021 2/2 Nepal without giving any information to her family members. Learned counsel for the petitioner submits that the petitioner is in custody since 30.04.2020, having clean antecedent.
Looking to the entirety of the matter, let the petitioner above named be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of A.D.J.-VI, Sitamarhi in connection with Bajpatti P.S. Case No. 100 of 2020, subject to the condition that one of the bailors of the petitioner shall be his close relative. The petitioner will not induce any witness or tamper with the evidence. The petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.
