The petitioner is in custody since 11.05.2022 in connection with Excise Case No. 98C2 of 2021 registered for offences under Sections 120(B)/34 of the Indian Penal Code read with Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2016.
There is recovery of 679.320 litres of english wine from the field of the petitioner.
Considering the fact that the petitioner has two antecedent of the similar nature and he is in custody since 11.05.2022, he shall be released on bail after framing of charge or on completion of one and half year in custody whichever is
Patna High Court CR. MISC. No.33051 of 2022(2) dt.20-08-2022 2/2 later, on furnishing bail bonds of Rs. 10,000/- (Rs. Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise Court-02, Begusarai in connection with Excise Case No. 98C2 of 2021. The petitioner will visit Excise Court on the first Sunday of each month. Any default in appearance at the police station would result in cancellation of bail bond of the petitioner.
