====================================================== CORAM: HONOURABLE MR. JUSTICE SATYAVRAT VERMA ORAL ORDER 23-11-2022 Heard learned counsel for the petitioner and learned A.P.P. for the State.

Let the defect(s), if any, be removed within a period of four weeks.

The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 341, 323, 324, 379, 307 and 506/34 of the Indian Penal Code. Learned counsel for the petitioner submits that petitioner is a person with clean antecedent and is a young boy, aged about 22 years.

The informant alleges that on account of dispute relating to land, the accused persons including the petitioner assaulted his wife causing injury on her right hand and also assaulted the informant and his son causing injury on their head and took away five sacks of wheat and cash of Rs.30,400/-.

No.32962 of 2022(2) dt.23-11-2022 2/3 Learned counsel for the petitioner submits that accused persons including the petitioner has been falsely implicated in the present case on account of dispute relating to land. It is further submitted that there is no specific allegation of assault against any of the accused persons and further the injuries suffered by the injured is simple in nature, though with respect to one injury of the informant, opinion is reserved but then the allegation of assault is not specific. It is next submitted that petitioner is a young boy and if he is sent to judicial custody his entire career would be jeopardized and chances are upright that he may come in contact of hardened criminals. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.

Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Banka (Barahat) P.S. Case No. 277 of 2021, subject to the conditions as
