2. The present application has been preferred for the following relief(s):

(i) to issue a writ in the nature of Mandamus to direct the respondents to make the land bearing Khata No. 256, Plot No. 1312, total area 195 Decimal and Khata No. 257, Area Total Plot No. 1310, Decimal and 18 respectively situated at Kabar P.S.-Bhabua, 40 decimal Mauza District-Kaimur nature of land Gair Mazarua Aam (of General people) which is a embankment of pond & pond also, encroachment free from encroachers because this piece of land is used by the general people of the village for common and different Purpose in order to maintain healthy natural environment which is being encroached by some people of the village under the influence of and in connection with the local authority of land &

(ii) to issue a writ in the nature of Mandamus to protect the interest of the of the General people village by making the said land absolutely encroachment free;

(iii) to direct district restrain those the to of administration authority administration the local people as and well from making any kind of encroachment over the said land existing for use of General people.

3. On 06.11.2015, prayer for adjournment was made by the petitioner while on 23.11.2015, on call, no one appeared. On 24.11.2015, it was recorded that the writ petition stands dismissed against respondent no. 7 for non-compliance of the order dated 17.09.2015.

4. Learned State Counsel submits that after the fact that the writ petition was dismissed against respondent no. 7, nothing remains.

5. Be that as it may, since there is no appearance, dismissed for non-prosecution.
