2. The petitioner has prayed for regular bail in a case registered for the offence punishable under Sections 25(1-B0 a, 26 and 35 of the Arms Act.
3. The case of the prosecution is that from the possession of one co-accused, Nokia mobile of this petitioner was recovered.
4. Learned counsel for the petitioner submits that though last recovery of weapon has been made but that is from other co-accused persons. Except Nokia mobile, there is nothing to involve this petitioner in the present case. It has also been submitted that the allegation does not attract Arms Act at all. The petitioner is having criminal antecedent of one case in which he is
Patna High Court CR. MISC. No.31595 of 2025(2) dt.15-05-2025 2/2 on bail. The petitioner is in custody since 05.03.2025.
5. Learned APP has also submitted that as only Nokia mobile has been recovered to link this petitioner in this case, Arms Act would not be attracted.
6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Triveniganj P.S. Case No. 119 of 2025 on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Supaul.
