Petitioner seeks bail in Dumraon P.S. Case No.202 of 2020 registered under Section 30(a) of the Bihar Prohibition and Excise Act.
The police on secret information about keeping of liquor in the house of Atarimani Sharma raided the house of Atarimani Sharma and apprehended Atarimani Sharma along with the petitioner. 155.50 litres of liquor was recovered from the house of Atarimani Sharma. On disclosure made by the petitioner, 18.900 litres of liquor was recovered from the house of Sushil Ram.
Learned counsel for the petitioner submits that the recovery was made from the house of Atarimani Sharma. No recovery was made from the house of the petitioner. Since the
Patna High Court CR. MISC. No.31472 of 2020(2) dt.01-12-2020 2/2 petitioner was fleeing away with Atarimani Sharma, the petitioner was apprehended and he is in custody since 09.06.2020. The petitioner has already remained in jail for about six months.
Taking into consideration the facts aforesaid, the petitioner named above is directed to be released on bail on furnishing bail bond of Rs.10,000/-(rupees ten thousand) with two sureties of like amount each to the satisfaction of learned Additional Sessions Judge II-cum-Special Judge (Excise), Buxar in connection with Dumraon P.S.
