2. The present writ petition has been filed for the following reliefs:- "(i) For commanding and directing the Respondents for payment of Group Insurance with 12% compound interest amounting Rs.2,36,603.00 (Some amount paid).

(ii) For commanding and

2/5 directing the Respondents for payment of promotional benefit from 27.07.1998 to 31.08.2014 which has not been fixed for his Senior Lecturer Scale and has not been paid differences of arrears of salary with effect from 27.07.1998 to 31.08.2014.

(iii) For commanding and directing the Respondents for pay fixation of pension according to Senior Lecturer Scale with effect from 31.08.2014 till date and pay differences of arrears of salary.

(iv) For commanding and directing the Respondents for payment of Rs.

32,860.00 in place of Rs. 32,250.00 and give the difference of salary from 01.01.2006 to till date.

(v) And/or any other appropriate relief(s) to the petitioner for which he may be found entitled in the eye of law."

3. Learned counsel for the petitioner submits that the petitioner was appointed as Demonstrator in in the Department of Physics in R.B.G.R. College, Maharjganj on 25.07.1972 by the competent authority and on the basis of the appointment letter issued, the petitioner had submitted his joining against the said post on same day in under Bihar University, Muzaffarpur. It has next been submitted that the petitioner was promoted on the post of Lecturer on 29.09.1989 and senior Lecturer on 27.07.1998. Subsequently, petitioner retired from the service on

3/5 31.08.2014 in the Department of Physics From R.B.G.R. College, Maharajganj, Siwan under Jai Prakash University, Chapra. The petitioner has filed several representations before the respondent with regard to payment of group insurance with compound interest @ 12 1⁄2 %, amounting to Rs. 2,36,603/-.

Petitioner has appended various orders of this Court, wherein the Coordinate Bench including this Court has directed the Registrar of the University to take final decision in the matters where such retiral benefits, mentioned by the petitioner in the relief portion, has not been extended in his favour.

In order to buttress, the petitioner at this stage, submits that his case may also be directed to be considered in light of the orders passed in CWJC No. 16318 of 2008, vide order dated 23.12.2014, CWJC No. 11955 of 2022, vide order dated 10.05.2023 and CWJC No. 11135 of 2024 vide order dated 22.10.2024, in which the Coordinate Bench of this Hon'ble Court has directed the respondents authorities to take steps by deciding the case of the petitioner in the light of the Judgment rendered in Professor Surendra Bahadur Singh Vrs. State of Bihar and analogous cases, reported in 2006(4) PLJR 369.

6. Learned counsel for the University endorses the submission of the learned counsel for the petitioner and submits that his case may also be directed to be considered strictly in consonance with the orders passed by the aforesaid Co-ordinate Benches of this Court as discussed above.

Considering the aforesaid, respondents are directed to decide the claim of the petitioner with regard to payment of group insurance as per applicable rate, which is mentioned in the Judgment and order of the Coordinate Bench and further the difference of arrears of salary on the post of Senior Lecturer w.e.f. 27.07.1998 to 31.08.2014, which has not been paid to him.

Considering the aforesaid, the petitioner is directed to file a fresh representation incorporating the relief portion, which is supported with the Judgments rendered by this Court and a Coordinate Bench of this Court with respect to the reliefs covered under the said Judgment and further with regard to payment of arrears of promotional benefits which according to this petitioner is said to have been granted w.e.f. 27.07.1998 to 31.08.2014.

9. On submission of such representation, the petitioner's grievance shall be redressed by the respondents and

5/5 if required, the petitioner may be called in question to submit further documents and on getting due assistance, necessary orders shall be passed by the respondents within a period of eight weeks from the date of production of a copy of this order. Consequential benefits shall also be paid to him without any inordinate delay.

10. The present writ application stands disposed of in terms thereof.
