BADAR ORAL ORDER 09-03-2022 The applicant is an accused in Crime No. 60 of 2019 (Sessions Trial No. 78 of 2020) registered with Laukaha (Lalmaniya) Police Station for the offences punishable under sections 363, 366(A)/34 of the Indian Penal Code, by this application is seeking his release on bail during pendency of the trial.
Heard both sides.
Earlier bail application of the applicant was rejected by the coordinate Bench of this Court on 10.12.2019 on the ground that minor girl could not be found. Ssubsequently also on 22.3.2021 similar application moved by the applicant was rejected by the coordinate Bench of this Court. Now minor girl has been traced out. The case against the applicant is to the effect that he along with co-accused had
Patna High Court CR. MISC. No.42201 of 2021(4) dt.09-03-2022 2/3 kidnapped minor female child of first informant mother in order to seduce her illicit intercourse and for marrying her against her wish. With passage of time now the missing minor female child is traced out. The applicant has filed supplementary affidavit pointing out the statement of the missing female child recorded under section 164 of the Cr.P.C. which is not disputed by the prosecution. The missing female child has stated that she had gone to Mumbai at her own and staying with a person named Mintu Ram for the last three years. She further stated that the present applicant is not concerned with her kidnapping. It is seen that the victim, with passage of time has turned to 21 years of age.
Considering this nature of evidence and subsequent development, I seen no reason to refuse bail to the applicant, hence, the order.
I. The application is allowed.
II. The applicant/accused in Crime No. 60 of 2019 (Sessions Trial No. 78 of 2020) registered with Laukaha (Lalmaniya) Police Station is directed to be released on bail on executing P.R. Bond of Rs. 10,000/- (Ten Thousand) on furnishing two sureties of the like amount to the satisfaction of the trial court with the following conditions:-

No.42201 of 2021(4) dt.09-03-2022 3/3 (I) The applicant/accused should not extend any threat, promise of inducement to the persons acquainted with the facts of the accusation against him so as to dissuade him from disclosing such facts to the Court or to any police officer. (II) The applicant/accused should cooperate the trial in expeditious disposal of the trial against him. (III) The applicant/accused should not contact the members of the prosecuting party as well as witnesses in this case in any manner till conclusion of the trial. (IV) The applicant should not repeat commission of similar offence in future and if he is found to be involved in commission of similar offence, the State is at liberty to apply for cancellation of bail granted to the applicant in the instant case. The applicant to remove all office objections forthwith and the Registry to issue certified copy of this order only after removal of office objections by the applicant/accused. (A. M.
