The petitioner has filed the instant application for modification of the order dated 23.03.2022 passed in Cr. Misc. No. 40095 of 2021, whereby while granting bail to the petitioner in connection with Guraru P.S. Case No. 51 of 2020, the petitioner was directed to surrender in the Court below within a period of four weeks.

It is submitted by learned counsel for the petitioner that to earn their livlihood, petitioner was out of State. Hence, the information regarding grant of anticipatory bail could not be communicated on time and accordingly, the period of surrender has expired. Hence, the petitioner prays for extension of

Patna High Court CR. MISC. No.67883 of 2023(2) dt.03-11-2023 2/2 surrender period.

It appears from order dated 23.03.2022, that petitioner was granted anticipatory bail and he did not comply with the order for more than one and half year.

In view of the causal approach adopted by the petitioner, in complying with the order of this Court and there is huge misuse of bail, I am not inclined to grant further extension of period for surrender.

Modification application stands rejected.
