JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 27-01-2015 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State, as also heard learned counsel for the informant.
The accusation against the petitioner No. 1 is that he gave Farsa blow to the informant and simultaneously, co-accused, Gurudeo Paswan gave sword blow to the informant. The informant sustained injury on his head. The injury of the informant has been found grievous in nature but in the opinion of the doctor, the aforesaid injury was caused by hard and blunt substance. Moreover, it is not specific as to who is author of the injury of the informant. So far as petitioner No. 2 is concerned; it is stated that he along with co-accused Kari Paswan @ Rajesh Paswan assaulted the informant's brother with Lathi and Khanti. Learned counsel, appearing for the informant could not
Patna High Court Cr.Misc. No.37121 of 2014 (3) dt.27-01-2015 2/2 succeed to produce any injury report of informant's brother nor the same is available in the case diary. Petitioners are in custody since long and the investigation against them has already been completed.
Considering the aforesaid facts and circumstances of the case as well as submission of the parties, let the petitioners named above be released on bail on furnishing bail bond of Rs 10,000/- (ten thousand) each with two sureties of the like amount each in connection with Khagaria (Muffasil) P.S. Case No. 15 of 2014 to the satisfaction of Chief Judicial Magistrate, Khagaria. (Hemant Kumar Srivastava, J) A.K.V./- U T
