JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 06-01-2021 Heard learned counsel for the petitioner and learned Additional Public Prosecutor appearing on behalf of the State. This application for grant of regular bail arises out of Town P.S. Case No. 365 of 2019 registered for the offence punishable under Sections 420, 414 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act, 2016. A total of 106.56 liters of Indian made foreign liquor was recovered from an esteem car, which was left abandoned. The petitioner has been made accused on the ground of his being the owner of the said vehicle. He is in custody since 06.07.2020.

Learned counsel for the petitioner has submitted that when the seizure was made, the petitioner was in custody in connection with Bhagwanpur P.S. Case No. 102 of 2019, from

Patna High Court CR. MISC. No.31573 of 2020(4) dt.06-01-2021 2/2 which case he has been remanded in custody in the present case. He has further submitted that if the petitioner is found indulging in similar offence in future and if any application for cancellation of bail is made by the prosecution in the present matter, the petitioner shall not oppose any such application for cancellation of bail.

Considering the submission that the petitioner was in custody on the date when the recovery of illicit liquor was made, this application is allowed.

Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-II, Begusarai cum Special Judge, Bihar Prohibition and Excise Act, in Town P.S. Case No. 365 of 2019.
