Petitioner seeks regular bail in a case registered for the offence punishable under Section 307/506/34 of the Indian Penal Code, Section 66 of I.T. Act and and u/s 27, 35 of Arms Act. .

As per the prosecution case, at a dance party in birthday celebration this petitioner along with other accused persons were indulged in indiscriminate firing during the course of celebration.

Learned counsel appearing for the petitioner submits that petitioner is innocent and has falsely been implicated in the case. There is no specific allegation against this petitioner. Similarly situated accused Niraj Kumar Bhatt has already been granted bail by a co-ordinate Bench of this court vide order

Patna High Court CR. MISC. No.43167 of 2021(2) dt.18-01-2022 2/2 dated 30.09.2020 passed in Cr. Misc. No. 25542/2020. Petitioner is in custody since 15.02.2021 and investigation in this case is complete.

Learned counsel appearing for the State opposes the prayer for bail.

Considering the facts of the case and the period of custody of the petitioner, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Bhojpur, Ara in connection with Charpokhari PS case No.191/2019.
