JUSTICE ASHUTOSH KUMAR ORAL ORDER 18-12-2018 Mr. Najmul Hoda, learned counsel for the petitioner, after some arguments, seeks permission to with this anticipatory bail petition in order to enable the petitioner to surrender before the court below within a period of four weeks and seek regular bail.

In case such a petition is filed within a period of four weeks from today, the court below shall look into the entire set of facts viz. that there was a dispute with respect to a plot of land; there was some talk of marriage between the petitioner and the prosecutrix and that the prosecutrix is not a minor and therefore the offences under the POCSO Act, 2012 would not get attracted and thereafter shall pass orders in accordance with law without being prejudiced by the fact that the present anticipatory bail petition has not been
