This court vide order dated 02.09.2015, adjourned the matter for three weeks awaiting the report of the Superintendent of Police, Sitamarhi. Since the report has been received, the matter has been taken up on merits.

The petitioner has renewed the prayer for bail since he is languishing in custody since 05.12.2012 in a case registered for the offences punishable under sections 302 and 120B/34 of the Indian Penal Code in connection with Riga P.S. Case No.122 of 2012, pending before the learned 1st ADJ, Sitamarhi. The prosecution case is that one Bhagwan Rai caught hold the son of the informant when on the order of Babulal Rai, this petitioner gave knife blow on the abdomen of the son of the

Patna High Court Cr.Misc. No.36518 of 2014 (6) dt.23-09-2015 2/2 informant, subsequently, the victim succumbed to his injuries. Learned APP for the State has produced the report of the Superintendent of Police, Sitamarhi dated 19.09.2015. Let the same be kept on record. The report of the Superintendent of Police, Sitamarhi suggests that the all the witnesses have been examined.

Considering the present stage of the trial, this Court is not inclined to revise the earlier order.

It is expected from the trial court to conclude the trial expeditiously.
