====================================================== CORAM: HONOURABLE MR. JUSTICE ASHUTOSH KUMAR ORAL ORDER 03-12-2020 Heard Mr. Ram Prawesh Kumar, learned counsel for the petitioners and the learned APP for the State.

The petitioners seek bail in connection with C-I Case No. 154 of 2020, which has been instituted for the offences under Section 30(a) of

Patna High Court CR. MISC. No.31416 of 2020(2) dt.03-12-2020 2/3 the Bihar Prohibition and Excise Act, 2016.

690.450 litres of liquor is said to have been recovered from a vehicle which was found to be occupying by the petitioners.

Learned counsel for the petitioners has submitted that the vehicle in question does not belong to them and the petitioner No. 2 was asked to drive the vehicle as the regular driver of the vehicle had been on leave. He has further submitted that both the petitioners did not have any idea about the liquor being kept in the vehicle. The petitioners are in custody since 26.08.2020 and have not been made accused in any other case up-till now.

Considering the aforesaid aspect of the matter, the petitioners above-named are directed to be released on bail on their furnishing bail bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Special Judge (Excise),
