JUSTICE ASHUTOSH KUMAR) 21-10-2022 After some arguments, Mr. Suryakant Kumar, learned advocate for the petitioners agrees that the petitioners would be satisfied if they are given an opportunity of agitating their claims before the Divisional Commissioner. On the petitioners making a suitable representation before the Divisional Commissioner, ventilating their grievances, such application shall be considered by the Divisional Commissioner and after providing hearing to the parties and finding out all the pros and cons of the appointment of the selection process, shall pass a reasoned order within a period of sixty days, to be counted from the date of presentation of a copy of this order.
We have referred the matter to the Divisional Commissioner in view of the notification dated 21.07.2022 issued by the Government in exercise of the powers conferred under Sections 3 and 5 of the Essential Commodities Act, 1955 read with Clause-36 of the Bihar Targeted Public Distribution System (Control) Order, 2016.
Patna High Court CWJC No.8774 of 2022(3) dt.21-10-2022 3/3 order passed by the Divisional Commissioner, they shall have the liberty to agitate the appropriate forum for the needful. The petition stands disposed of.
