Petitioner is in custody in connection with Gaya Excise Case No. 263 of 2020 on (P.R No. 38/20-21) for the offence under sections 30(a) of the Bihar Prohibition and Excise Act, 2016.

Learned counsel for the petitioner submits that petitioner has no criminal antecedent.

In the instant case total 71.625 liters of wine was seized from the vehicles namely, Bolero and Pickup Van. The petitioner is in custody since 29.6.2020. Considering the fact that petitioner has no criminal antecedent, the Court is inclined to grant bail to the petitioner, let the petitioner, named above, be enlarged on bail on

Patna High Court CR. MISC. No.31007 of 2020(2) dt.08-01-2021 2/2 furnishing bail bond of Rs. 25,000/- (Twenty five thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge,Excise Court, Gaya, in connection with Gaya Excise Case No. 263 of 2020 (P.R. No. 38/20-21) subject to the condition that the petitioner shall deposit Rs. 25000/- cash to the court below and the amount of Rs. 25000/- deposited by the petitioner shall abide by final outcome of Gaya Excise Case No. 263 of 2020.
