Let the defect(s), if any, be removed within four weeks. Petitioners seek bail in a case registered for the offences punishable under Sections 20, 22, 23, 24, 27, 27A and 29 of the Narcotic Drugs and Psychotropic Substances Act, 1985. Five-hundred grams of Charas was allegedly recovered from possession of the petitioners. 1 Kilogram Charas was recovered from possession of co-accused Sakaldeep Kumar and Sandi Yadav. The petitioners are in custody since 15.07.2020.
Patna High Court CR. MISC. No.42773 of 2021(2) dt.06-10-2021 2/2 In the past, prayer for bail was refused on 13.04.2021 with liberty to the petitioners to renew the prayer after framing of the charges.
Submission is that charges have already been framed and the petitioners are ready to cooperate with the trial. The recovered quantity is less than commercial quantity. Considering the facts aforesaid, let the petitioners, above named, be released on bail on furnishing bail bonds of Rs.20,000/- (Rupees Twenty Thousand) each with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Hajipur Town Police Station Case No. 453 of 2020, subject to the following conditions:- (a) The petitioners shall fully cooperate with the trial of the case, failing which the learned court below shall be at liberty to cancel the bail bond of the petitioners.
(b) Both the bailors shall be resident of territorial jurisdiction of the learned court below.
(c) The petitioners shall not leave the country without permission of the court.
