Petitioner seeks regular bail in a case registered for the offence punishable under Section 302 and some other ancillary Sections of the Indian Penal Code.
As per the prosecution case, this petitioner along with six named accused persons and five unknown persons assaulted and killed the son of informant and threw his dead body in the field behind Jharkhandi Baba temple.
Learned counsel appearing for the petitioner submits that petitioner is innocent and has falsely been implicated in the case. Informant is not an eye witness of the occurrence. There is general and omnibus allegation and no specific overt act has been alleged against this petitioner. Similarly situated accused Renu Devi has already been granted bail by a
Patna High Court CR. MISC. No.43150 of 2021(2) dt.18-01-2022 2/2 co-ordinate Bench of this court vide order dated 04.06.2020 passed in Cr. Misc. No. 14010/2020. Petitioner claims clean antecedent and is in custody since 14.08.2020 and investigation in this case is complete.
Learned counsel appearing for the State opposes the prayer for bail.
Considering the facts of the case and the period of custody of the petitioner, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Nalanda at Biharsharif in connection with Rajgir PS case No.261/2019.
