2. The petitioner is in custody in connection with Raghunathpur, P.S Case No. 624 of 2023 registered for the offence punishable under Sections 272, 273 B.N.S., 30(a) and 41(1) of the Bihar Prohibition and Excise Act..

3. As per allegation in the FIR, there is recovery of total 70 liters of country made liquor near the Majhariya river.

4. Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case. He next

It is also submitted that petitioner is not present at the place of occurrence rather he has been identified by the local chowkidar. He further submits that petitioner is in judicial custody since 09.01.2026 having fourteen criminal antecedents.

5. However, learned APP for the State oppose the prayer for regular bail of the petitioner.

6. On perusal of the FIR and impugned order dated 01.04.2026, it appears that there is recovery of 70 liters of country made liquor near the Majhariya river and not from the conscious possession of the petitioner. Moreover there is no independent witness to the seizure list. Therefore, considering the aforesaid facts and circumstances of the case and submissions made on behalf of the learned counsel for the petitioner, let the above named petitioner be released on regular bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Learned Exclusive Special Excise Judge Court No.1 East Champaran, Motihari in connection with Raghunathpur, P.S Case No. 624 of 2023 subject to condition that petitioner shall appear each and every date fixed by the trial Court till the
