The petitioner has prayed for bail in a case registered for the offence punishable under sections 25 (1-b)a/26 of the Indian Penal Code.
As per allegation in the FIR, on seeing the police party, petitioner started to flee by his motorcycle but on chase he was apprehended and from his possession, one loaded country pistol and two live cartridge were recovered. It is submitted by learned counsel for the petitioner petitioner has been falsely implicated in this case. He is innocent. The alleged recovery shown by the police is not real rather the same is transplanted by them. There is no compliance of Section 100 of the CrP.C. and one of the witness of seizure
Patna High Court CR. MISC. No.32632 of 2022(4) dt.13-02-2023 2/2 list is Chaukidar. Petitioner is languishing in judicial custody since 26.04.2022.
The application for bail is opposed by learned APP for the State.
Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned SDJM, Barh, Patna in connection with Belchi P.S.
