JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 06-12-2018 Heard learned counsel for the petitioner as well as learned Addl. Public Prosecutor for the State. Petitioner apprehends his arrest in connection with Kopa P. S. case no. 73/2018 registered under sections 307, 379 and other minor sections of the IPC.

Altogether, 11 persons including the petitioner are named in the first information report with allegation that they assaulted the informant. The impugned order goes to show that husband and son of the informant sustained five injuries each and the informant has also sustained injuries but nature of the injury has not been disclosed by the learned Sessions Judge, Saran in the impugned order. However, learned counsel for the petitioner submits that having more or less similar allegation, co-accused Lakhichand Yadav has already been granted

Patna High Court Cr.Misc. No.67547 of 2018(2) dt.06-12-2018 2/2 privilege of anticipatory bail by a coordinate bench of this court vide order dated 28.8.2018 passed in Cr. Misc. no. 49348/2018. Considering the aforesaid facts and circumstances as well as submissions of the parties, in the event of arrest/ surrender within four weeks from the date of receipt of this order to the concerned court, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Addl. Chief Judicial Magistrate V, Saran at Chapra in Kopa P. S. case no. 73/2018 subject to condition as laid down under section 438(2) of the Cr.P.C.
