2. The petitioner has renewed his prayer for grant of regular bail in connection with NDPS Case No.165 of 2025, arising out of Nakardei P.S. Case no.44 of 2025 registered under sections 8(c), 21(c) and 29 of the NDPS Act.

3. There is a recovery of 7.290 kgs of smack, which was buried in the ground near a bridge.

4. Learned counsel for the petitioner submits that earlier the prayer for bail of the petitioner was dismissed as withdrawn vide order dated 12.02.2026, giving liberty to the petitioner to renew his prayer for bail after framing of charge. Referring to the order dated 01.04.2026 (Annexure-P/3), it is submitted that charge has been framed against the petitioner for the offence punishable under Section 27(c) of the Drugs and Cosmetics Act. Further, similarly situated co-accused person has been granted bail by co-ordinate

Patna High Court CR. MISC. No.31255 of 2026(2) dt.15-05-2026 2/2 Bench of this Court vide order dated 13.02.2026 passed in Cr. Misc. No.1324 of 2026 (Annexure-P/4). The petitioner is in custody since 01.07.2025 and undertakes to cooperate in the trial.

5. The application for bail is opposed by learned A.P.P. for the State.

6. Taking into consideration the aforesaid facts and circumstances of the case and also considering the liberty granted to the petitioner by the aforesaid order of dismissal dated 12.02.2026, charge having been framed in the case, coupled with the fact that similarly situated co-accused person has been granted bail by coordinate Bench of this Court by aforesaid order dated 13.02.2026, the petitioner is directed to be enlarged on bail in connection with NDPS Case No.165 of 2025, arising out of Nakardei P.S. Case no.44 of 2025 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Court concerned where the case is pending/successor Court.
