2. With the consent of both the parties, this writ application is being disposed of at the present stage itself.

3. The petitioner in the present writ application has prayed for the grant of following reliefs:- "a. For direction to respondents including District Education Officer, Madhepura to issue appointment letter for petitioner to the post of Assistant teacher in Secondary School under Madhepura Zila Parishad in subject of music against the advertisement dated 7th July, 2012.

b. Also declare action of respondent in not issuing appoint letter in favour of the petitioner to post of Assistant teacher in the subject of music under Madhepura

Patna High Court CWJC No.14215 of 2017(5) dt.19-12-2025 2/3 Zila Parishad is illegal and bad in law.

c. Also for direction respondent to give all consequential service benefit to the petitioner considering the merit position in subject of music under Madhepura Zila Parishad against advertisement on 7th July 2012.

d. Also for necessary relief, order, direction for which the petitioner is entitled in the eyes of law."

Learned counsel for the petitioner submits that for seeking the reliefs as claimed for in the present writ application, the petitioner is prepared to file a detailed representation before the Director, Secondary Education, Government of Bihar, Patna (Respondent No. 2) and he further prays if such a representation is filed, the same may directed to be considered on merit after giving an opportunity of hearing to the petitioner. Learned counsel for the petitioner further prays that time frame may kindly be fixed within which respondent no. 2 should be directed to dispose of the representation filed by the petitioner.

5. To this prayer being made by the learned counsel for the petitioner, the learned counsel appearing for the Respondent-State does not have any objection.

6. Considering the limited nature of prayer being made by learned counsel for the petitioner, this writ application is disposed of granting liberty to the petitioner to file a detailed

Patna High Court CWJC No.14215 of 2017(5) dt.19-12-2025 3/3 representation before the Director, Secondary Education, Government of Bihar, Patna (Respondent No. 2) within three months from the date of production of a copy of this order. If such a representation is filed by the petitioner, the same shall be heard and disposed of on merit after giving an opportunity of hearing to the petitioner, by passing a reasoned and speaking order. The entire exercise must be carried out within a period of six months from the date of filing of the representation by the petitioner. Needless to emphasize that the final order which shall be passed by the Director, Secondary Education, Government of Bihar, Patna (Respondent No. 2) should be a reasoned and speaking order.

7. With the aforesaid observation, directions and liberty granted, this writ application is disposed of. All pending Interlocutory Applications, if any, shall stand disposed of. (Alok Kumar Sinha, J) Gaurav Sinha/- U
