2.The petitioner is not named in the F.I.R. and apprehending his arrest in connection with Muffasil P.S. Case No. 22 of 2025 registered for the offences punishable under Sections 331(4), 305 of BNS.
3. As per FIR, gold and valuable items worth of Rs. 15 lakhs were stolen from the house locker of the informant, where suspicions raised against named accused Bittu Kumar.
4. It is submitted by learned counsel appearing on behalf of the petitioner that the informant raised entire suspicions against named co-accused Bittu Kumar and
Patna High Court CR. MISC. No.33225 of 2025(2) dt.21-05-2025 2/3 during course of investigation on his confession the name of this petitioner transpired in present case. It is pointed out by learned counsel that in furtherance of confession the house of petitioner was raided but no incriminating materials as stolen was also recovered. It is pointed out that the petitioner passed Intermediate examination with first division and having a promising carrier. While concluding argument, it is submitted that petitioner is a man of clean antecedent.
5. Learned APP opposes the prayer of bail.

In view of aforesaid factual submission and by taking note of fact that as nothing incriminating material recovered from the house of the petitioner where primafacie even suspicion not appears raised against this petitioner by the informant, accordingly petitioner abovenamed, in the event of his arrest or surrender before the court below within a period of four weeks, is directed to be released on bail, furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like
Patna High Court CR. MISC. No.33225 of 2025(2) dt.21-05-2025 3/3 amount each to the satisfaction of the learned CJM, Khagaria/concerned Court, where the case is pending in connection with Muffasil P.S. Case No. 22 of 2025, subject to the conditions as laid down under Section 438(2) of the Cr.P.C/ Section 482(2) of BNSS, with further condition:- "(i) That petitioner shall not involve in the similar nature of offence till the conclusion of trial, failing which the State shall be at liberty to move before the Trial Court itself for the cancellation of bail bond of the petitioner."
