2. The petitioner apprehends arrest in a case registered for the offence punishable under sections 379, 498A, 504, 506/34 and other allied sections of the Indian Penal Code and sections 3 & 4 of the Dowry Prohibition Act.
3. Learned counsel appearing for the petitioner submits that the dispute between the parties has amicably been settled and as per the condition of the settlement, petitioner has to pay Rs. 6 lacs as one time settlement to opposite party no.2 by way of bank draft and opposite party no.2 on her turn, shall withdraw the present criminal case.
4. This fact is not controverted by learned counsel appearing for the opposite party no.2.
5. Considering the submission of the parties, prayer for bail of the petitioner is allowed. In the event of arrest/surrender within six weeks from today, let the petitioner, mentioned above, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Doriganj Police Station Case No. 198
Patna High Court CR. MISC. No.33577 of 2023(4) dt.21-08-2023 2/2 of 2022 from the Court of the Additional Chief Judicial Magistrate VI, Saran at Chapra, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
6. Petitioner shall hand over bank draft of Rs.6 lacs to the opposite party no.2 at the time of furnishing bail bond, failing which this order shall not be given effect to. (Prabhat Kumar Singh, J) Shashi U T
